How Does SSA Define Disability?
The Social Security Act defines “disability as “inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment which can be expected to result in death or has lasted or can be expected to last for a continuous period of not less than 12 months.”
Don’t be scared off by the legal terminology! In ordinary language, to be found disabled, you have to prove you have been or are going to be unable to work for at least one year due to one or more physical or mental health conditions.
Many people assume their condition will improve quickly or are not sure whether they will be able to work in 12 months. That can be a costly mistake!
